Addendum to the General Agreement

This addendum to the General Agreement stipulates the essential conditions to which all owners of properties in the Konia Village 3 development are required to conform to. These requirements have been defined by, agreed to and confirmed by, the Konia 3 Owners Group Management Committee and as such are binding on all owners.
This Addendum is circulated to all owners and it is incumbent on each owner to ensure that it is supplied to all tenants that may from time to time be resident in their property and also to any management company that may be employed to service/administer their property and that all tenants and/or management company shall comply fully with these requirements.
Owners must be aware that any failure to comply with the requirements laid down in this ‘Addendum to the General Agreement’ either by the owner, their tenant, management company or any other person that the owner would normally have been expected to have informed, is liable to lead to financial penalties being imposed upon them as stipulated in paragraph 14 of the General Agreement – ‘Breach of this agreement’.


Requirements:
1. Owners having one or more gardens attached to their property shall ensure that they are maintained to a satisfactory standard and kept in such a way as not to be unsightly, cause annoyance to others or provide home or refuge to unwanted animals, eg snakes, rats, etc.

Gardens shall at all times:

• not be left unmaintained, be unsightly or be allowed to “go to seed”.
• not be used as a ‘dumping ground’ for household items, eg furniture, old fridges, etc
• not be used for the storage of chemicals, oils, petrol or any other flammable or dangerous liquid, compound or gas. (Garden and household chemicals permitted).

2. Owners and their tenants are permitted to keep pets in their property with the following provisions:

• No pet shall cause annoyance or distress to other residents on the development at any time and this applies whether the pet is inside or outside of a property. eg No barking dogs.
• Pets outside of a property shall at all times be suitably restrained. eg Dogs must be on a lead.
• Residents that ‘walk’ their pet within the gardens, car parks or approach roads are required at all times to remove and suitably dispose of any excrement that their pet may deposit.
• At no time is it permitted to walk or have their pet anywhere within the pool area.

3. Overnight guests of owners or tenants are permitted to use the communal areas, ie the pool and garden area.


Except in special circumstances or a ‘one-off’ visit, it is not permissible for friends of overnight guests to use the communal facilities (ie, a guest’s family or friends on a day visit and not residing on the development overnight).


4. It is not permitted to erect any aerial, satellite dish, other broadcast receiving equipment or any other apparatus to any wall, structure, balcony, support, railing , etc where it would be visible to others on the development.
All apparatus of this nature shall be erected out of sight on the roof areas, where preinstalled cable has been provided by Aristo for direct connection to each property.
Notification to the K3OG committee must be given prior to any such installation.

5. Except for special needs, eg moving furniture in or out of apartments, it is not permitted to wedge open or otherwise obstruct the automatic closure of the security door at the entrance to the stairwell in any apartment block. This is a serious security risk for all owners in the block.


6. All stairways and landings within each apartment block shall at all times be kept free of obstruction and on no occasion is any stair or landing to be used as a storage area for any item whatsoever. This could cause a major hazard should the block be required to be evacuated in an emergency.


7. In order to maintain the high standard, the general tidiness, pleasant appearance and character of the development, all balconies and patios that face the communal areas shall at all times be kept in an orderly and tidy manner. eg it is permissible to have a table and chairs, flowers pots, etc but items such as fridges, fridge-freezers, tumble driers, sheds, etc. are not permissible.


8. Allocated private parking spaces are to be used solely for the purpose of parking residents motor vehicles for their own particular property. Guests may use allocated spaces only with the express permission of the appropriate resident. Other vehicles shall use the ‘Common’ spaces, or if occupied they shall use the public highway outside of the development. No vehicles may be parked in any other area of the car-parks or approach roads as this will cause manoeuvring hazards for other vehicles.


9. No areas of the car-parks, approach roads, pool area, gardens or pathways may at anytime be used for the playing of ball games. Can we please remind residents that children MUST NOT play in the car parking areas and the gardens. playing ball games (which is forbidden) and riding scooters, bikes and generally playing around in the car park. It should be noted that under this General Agreement and its Addendum, which all residents should have signed during the purchase of their properties or tenancy agreement. The committee is legally bound to enforce Sections 9 of the General Agreement and its Addendum.


10. The parking of vehicles with the intent to repair, maintain or overhaul, whether for monetary gain or not, is prohibited on all common areas of the development including car-parks and approach roads.


Normal activities associated with keeping residents, visitors or guests vehicles clean and roadworthy are permissible. eg cleaning, wheel changing, topping up fluids necessary for the safe operation of their vehicle.

11. Children under the age of 16 are not permitted to use the garden and pool areas unless accompanied by an adult due to the dangers associated with the proximity of the deep adult pool.

12. Bicycles shall not be ridden within any area of the pool or gardens. Bicycle tyres leave black marks which are difficult to remove from tiles and pathways. We would ask you to ‘walk’ the bicycles anywhere on the development. Bicycles may not be used in the car parking areas. The committee is legally bound to enforce Sections 12 of the General Agreement and its Addendum.


13. The lifebelts and the pool cleaning net, which are housed on the pool fence, are not to be used for any purpose other than that for which they were designed. ie they are not to be used as toys or playthings in or around the pool.
14. All rubbish is to be placed in the provided rubbish bins. No rubbish is to be placed on the ground adjacent to the rubbish bins as this attracts vermin, dogs, cats, etc.
