NEW BUSINESS


24.1  COMMITTEE

JBCM advised that K3OG must have a committee of at least three members. Mrs. Sheila Wright therefore offered to act as the third member to join Mr. Pugh and Mr. Butcher. The meeting unanimously agreed to Mrs. Wrights appointment as the K3OG Treasurer.

MATTERS ARISING


24.2 FINANCIAL STATUS

The Chairman tabled a series of spreadsheets* setting out all communal charges invoices issued and paid to date.

The financial status was summarised as follows:-

Following the full payment of arrears by some defaulting owners the Committee and JBCM will continue with legal proceedings against the following remaining defaulting owners:-
If your property is managed by Elite Properties please instruct them to pay immediately.
They have not yet paid and once legal action has commenced you will be charged legal fees.

24.4 LEGAL ACTION – [In Progress]

a. Registration of K3OG

The lawyer has been authorised to proceed. Next meeting scheduled for October. A copy of the contract with the lawyer will be posted on our website as soon as K3OG registration has been completed.

b. Action Against Non-Payers
The lawyer has been authorised to proceed and K3OG has forwarded them details of defaulting owners. Next meeting scheduled for October.

c. Funding Legal Action
The Committee has raised some funds to proceed with the legal registration of K3OG and the commencement of legal action against defaulting owners. More funds are required in order to complete the legal process. The Committee would like to thank all those caring owners who have contributed to the fund.

24.7 ELECTRICITY METER DEPOSITS – [CLOSED]

The electricity authority has agreed to refund €1’356.00 to our account with JBCM being the balance due to us from our initial meter deposit with Lazydaze Ltd. Copies of the bills covering the balance amounts debited are to be forwarded to K3OG by JBCM.


24.8 OTHER BUSINESS

b. Property Agents – [In Progress]

It was noted that several owners on the complex are using unregistered agents to manage their properties. This matter will be raised with the lawyer.

NEW BUSINESS

25.1 SWIMMING POOL

There is ongoing discussion in Cyprus regarding the legal status of swimming pools within private complexes. The issue is that under EU law our pool is regarded as private and the tough rules regarding public pools do not apply. However a written response from an EU official to the owner of a Cyprus property appears to suggest that an EU member state can impose tougher rules if they feel they are justified. As a result Cyprus appears to be classifying many private pools as public, and has taken legal action against a few owners who have failed to comply with “public” pool standards. We do not yet know what the justification was for this action.

The rules for public pools are more onerous [and more expensive to implement] and include the requirement for a full-time lifeguard, and alterations to some of the pool facilities.

An organisation calling itself the Cyprus Communal Guide has organised a petition page on Facebook for people to request a review of the current Cyprus law. Steve Butcher will post a link to this petition on our website. We urge all owners [including each individual owner] to sign the petition requesting a review. If we cannot get the Cyprus Law changed we face either having to close the pool or pay significant increased cost to run it.

25.2 ACCOUNTS – [CLOSED]

JBCM are requested to forward a copy of their invoice 310 to enable K3OG to reconcile the accounts please. POST MEETING NOTE: Information received.
