1 COMMUNAL CHARGES
Sarah confirmed that reminders have been sent to those owners who have failed to pay their 2020 contributions to date. CLOSED
2 FINANCIAL REPORT
Spencer tabled draft copies of the Financial Report to 31 December 2019 and the Financial Report to 30 June 2020. Details were corrected and clarified and one item of 32cents remains to be examined by JBCM. Subject to clarification Spencer to update these reports and arrange to have them published on the private area of the K3OG website for owners to see. Spencer noted that having recovered €5’500.00 in unpaid communal charges during 2019 the Committee is yet again facing the new challenge of trying to recover €35’000.00 in unpaid communal charges. There will be very serious consequences if owners fail to take their financial responsibilities seriously. THIS MAY INCLUDE THE CLOSURE OF THE COMMUNAL SWIMMING POOL. Which is now in need of urgent major repairs. ACTION Spencer
3 OVERGROWN GARDENS
We now have complaints that a number of private gardens are not being maintained and that they are now overgrown and unsightly. It was agreed that the Committee will now arrange to have these gardens cleaned up to an acceptable level and that the cost of this action to be contra charged to the respective owners in accordance with Clause 7(h) of the General Agreement. 4 RESERVE FUND
Spencer to obtain quotations for the following works:-
(a) Decoration of external faces of garden walls to Blocks 2;4;5;6
(b) Replacement of the wooden fence at the south side of the swimming pool with a painted masonry wall.
(c) Painting of the small “tulip” lamps together with the repair of one loose/broken unit.
(d) Repair of loose fixings to the entrance gate adjacent to Block 6.
(e) Installation of metal or mesh rubbish bins at swimming pool to replace the broken plastic units. ACTION Spencer
5 BLOCK 1 – No106
It is noted that the owner of No106, Block 1 has failed to make monthly payments towards communal charges as promised by his lawyer as part of our out-of-court settlement with them. It was agreed as follows:-
(a) Sarah to request our lawyers to write to his lawyers to advise of this breach in the agreement.
(b) If/when the arrears reach €1’000 we should recommence legal proceedings and instruct our lawyers that (due to his failure to keep to
the agreed terms and conditions of his previous settlement) we will not accept any further out-of-court settlements. ACTION Sarah PENDING
6 MEETING WITH LAWYER
It was agreed that we should arrange a meeting with our lawyers as soon as possible to discuss the following matters:-
(a) Legal action against Aristo Developers for the recovery of communal charges on the two properties for which they still retain the title deeds.
(b) Legal action against those property agents who are collecting rents but failing to make payments of communal charges.
(c) Legal Action to allow the committee to collect communal charges payments directly from paying tenants.
(d) Whether we (or the local public health inspector) can gain access to those properties that have been left empty for several years. To ensure that they are in a safe / hygienic condition.
(e) Whether we can insist that tenants and/or property agents provide full
contact details of their respective property owners.
New Business 28 January 2020
1 ELECTRICAL FAULT – Block 6 One owner has reported no power to the communal stairs of Block 6. Spencer to investigate. Agreed that Sarah will arrange for James to inspect and advise. Spencer has keys to allow access. ACTION Sarah/James/Spencer
4 BLOCK 1 – No106
Sarah tabled an “offer” from the owner that he will make a lump sum payment of a substantial portion of his arrears, together with payment of a half of the current legal costs and a monthly payment towards future communal charges. The meeting agreed to accept the lump sum and legal charge contributions but that he should be required to pay a slightly increased monthly charge calculated at
exactly 1/12th of the annual charges invoiced to him. [i.e. no discount on current and future charges]. Spencer reminded the meeting that his claim that he only paid €42 per month when Aristo was “in charge” does not reflect (a) inflation (b) that Aristo charges
did not include communal insurance or (b) legal charges forced upon us by nonpayers such as himself. It should also be noted that his charges have only increased by the (VERY SMALL?) amount of €2.75 per month!

5 BLOCK 8 – No17
Sarah reported that GKZ have secured a Court Judgement against the owner for the full value of the arrears to the end of 2019. The meeting agreed that we should now collect the Court Judgement papers [including an English translation] and deposit these at the Land Registry with a request by K3OG that they be registered as an encumbrance. At this time we should not follow the route of instituting further legal proceedings that could lead to the arrest or imprisonment of the owners. CLOSED
6 ARREARS – STATUS
(a) Of the original 7 defaulters we now have 3 out-of-court settlements and 1 Court Judgement. It was agreed that this information can be posted on the owner’s forum – but without specific details. CLOSED
(b) We should obtain a copy of the letters previously sent from GKZ to the UK non-payers and resend them to those owners [via UK surface mail?] including a copy of the Court Judgement [with specific details blacked out] as a “warning” of the impact of further delay in payment and with a note advising of the total legal costs attached to the judgement – [which may increase the longer it takes to make payment ???]CLOSED
