Many owners show no interest in the management and maintenance of Konia Village 3 and no owner appears to be prepared to offer practical help to the current two committee members trying to deal with this task.
To make matters worse 14 owners are now late in paying their communal charges and 9 owners have made no communal charges payments within the last 20 months.
With communal charges arrears running in excess of €25’000, the Committee is now left with the almost impossible task of trying to maintain the Konia Village 3 complex to a reasonable standard without the funds to achieve this.
Sadly many owners, agents and tenants treat the two VOLUNTEER committee members as their servants/employees. The Committee members often suffer verbal abuse, threatening phone calls and receive utterly disgraceful emails from residents, agents and some owners. Some disreputable agents even fan the flames of dissent by deliberately creating an “us-and-them” approach to dealings between tenants and the Committee.
It is clear that some non-resident owners who have paying tenants in their properties fail to comply with the Local Law in that (a) they fail to appoint registered property agents to manage their properties (b) they fail to make their tenants aware of their legal obligations especially with regard to the General Agreement, the Management Agreement and the K3OG Constitution and (c) they show no interest in ensuring that their tenants are placed under an obligation to respect the rights of their neighbours to peaceful enjoyment of the KV3 complex. [see General Agreement, Clause 8(j)] Sadly some of these owners are selfish enough to even avoid paying their communal charges.
Steve Butcher and I [the remnants of your committee] came to Cyprus to enjoy a peaceful retirement. In view of the apathy of owners in general and the fact that between us Steve and I have given you over 17 years of assistance FREE OF CHARGE, we have both decided to revert to Plan A. Namely that we will now make our peaceful retirement our main priority and that we shall therefore be doing the absolute minimum required, regarding the management and maintenance of Konia Village 3 until you elect a new committee.
In 2018 we appointed JBCM as our property management contractor with a view to them reducing the amount of time and effort that the Committee has to spend “sorting out problems”. Sadly in many cases our workload has increased partly due to the amount of maintenance required on this 12 year old complex, and to the number of requests from owners to help them with “private” matters. With immediate effect owners and agents should please direct all maintenance and management issues exclusively to our property management company JBCM. Tenants should be instructed to refer all complaints to their landlord or property agents, not to JBCM. Steve and I will reduce our role only to the approval of non-recurrent expenditure (subject to the availability of funds).
In 2018 we appointed G. Kouzalis as our lawyers with the aim of achieving two principal objectives (a) to obtain legal enactment of Konia Village 3 according to CAP224 of the Cyprus Constitution and (b) to institute legal proceedings against those owners that were failing to pay their communal charges. The legal enactment of Konia Village 3 was completed on 29 October 2018. Whilst legal action against non-paying owners has achieved some success, it seems clear that we are now no longer deriving significant financial benefit from any further legal action. Your committee therefore proposes to review the current contract with G.Kouzalis.
Our records show that the majority of owners make very little use of our website and email address. As the maintenance of these IT services involves Steve in a significant amount of work, we propose to abandon them both at the end of the current contract [August 2021]. If there is another owner who has the IT capability to maintain these sites please let us know.
